Privacy Statement — JEK Recruitment B.V.

JEK Recruitment B.V. ("JEK Recruitment", "we", "us") respects your privacy and is committed to protecting your personal data. This privacy statement explains how we collect, use, store and protect your personal data when you apply for a role, register as a candidate, use our website, or otherwise interact with us. It applies to all candidates and visitors to www.jekrecruitment.nl.

1. Who we are

JEK Recruitment B.V. is the data controller responsible for your personal data.

2. The personal data we collect

Depending on how you interact with us, we may collect the following categories of personal data:

  • Identification and contact details: name, address, telephone number, email address, date of birth, nationality

  • Professional details: CV, employment history, education, qualifications, certifications, languages

  • Application-related information: cover letter, references, interview notes, assessment results

  • Compensation expectations and availability

  • Information you share with us during conversations or correspondence

  • Information from publicly available professional sources, such as your LinkedIn profile

  • Website usage data (cookies, IP address, browser type) when you visit our website

3. How we use your data and the legal basis

We process your personal data for the following purposes and on the following legal bases under the GDPR:

  • To assess your suitability for current and future interim and permanent roles — legal basis: legitimate interest (Art. 6(1)(f)) and, where you have actively applied, steps prior to entering into a contract (Art. 6(1)(b))

  • To share your profile with a specific client for a specific vacancy — legal basis: your consent (Art. 6(1)(a)), obtained per vacancy

  • To keep you informed of relevant roles, market news and JEK updates — legal basis: legitimate interest and, where required, consent

  • To enter into and perform contracts with placed candidates and clients — legal basis: contractual necessity (Art. 6(1)(b))

  • To comply with legal obligations, such as tax, accounting and screening requirements — legal basis: legal obligation (Art. 6(1)(c))

We share your CV or full profile with a client only after we have obtained your specific consent for that vacancy.

4. Who we share your data with

We share your personal data only with parties that need it for the purposes described above:

  • Our clients, where you have consented to being put forward for a specific vacancy

  • Our service providers (sub-processors), who process data on our behalf under a Data Processing Agreement:

    • Loxo — our applicant tracking system (ATS/CRM)

    • Microsoft 365 — email, document and file storage

    • E-boekhouden — invoicing and accounting (used only for placement and contract administration)

  • Regulatory, tax or law-enforcement authorities, where we are legally required to do so

We do not sell your personal data, and we do not outsource our recruitment work to third-party agencies or junior staff. All candidate work is carried out by our own senior consultants.

5. International transfers of your data

Most of your data is stored and processed within the European Economic Area (EEA).

One of our sub-processors, Loxo (our ATS/CRM), is based in the United States and processes data there. For this transfer, we rely on the following safeguards under the GDPR:

  • The EU Standard Contractual Clauses (SCCs)

  • Loxo's certification under the EU-US Data Privacy Framework

  • Encryption of data in transit (TLS 1.2+) and at rest (AES-256), and Loxo's SOC 2 Type II certification

A copy of the relevant safeguards is available on request via privacy@jekrecruitment.nl.

6. How long we keep your data

We keep your data only for as long as necessary for the purposes set out above:

  • Candidate data, with your consent for future roles: up to 2 years from your last active contact with us, after which we will ask whether you would like us to retain it for a further period

  • Candidate data, without consent after an unsuccessful application: up to 4 weeks after the conclusion of the application process, in line with guidance from the Dutch Data Protection Authority

  • Placement and contract data: up to 7 years after the end of the assignment, to meet Dutch fiscal and statutory retention requirements

  • Website usage data: in line with our cookie policy

After these periods, your data is deleted or anonymised.

7. Your rights

Under the GDPR, you have the following rights in relation to your personal data:

  • The right of access to your data

  • The right to rectification of inaccurate or incomplete data

  • The right to erasure ("right to be forgotten")

  • The right to restriction of processing

  • The right to data portability

  • The right to object to processing based on legitimate interest

  • The right to withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal

To exercise any of these rights, please contact us at privacy@jekrecruitment.nl. We will respond within one month, in line with Article 12 GDPR. There is no charge for exercising your rights.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) at www.autoriteitpersoonsgegevens.nl.

8. Automated decision-making

We do not use automated decision-making or profiling that produces legal or similarly significant effects for candidates within the meaning of Article 22 GDPR. All shortlisting and selection decisions are made by our senior consultants.

9. Security

We have put in place appropriate technical and organisational measures to protect your personal data, including access controls, encryption, and Data Processing Agreements with all sub-processors. Our sub-processors hold relevant certifications (ISO 27001, SOC 2 Type II).

10. Cookies

Our website uses cookies to support functionality and analyse website usage. You can manage your cookie preferences via your browser settings.

11. Changes to this privacy statement

We may update this privacy statement from time to time. The most recent version will always be available on www.jekrecruitment.nl/compliance. The date at the top indicates when it was last updated.
